These Terms of Sale (“Terms”) govern the sale of products by Need That Idea (“we,” “us,” “our”) to you (“Customer,” “you,” “your”). By purchasing our products, you agree to be bound by these Terms.

1. Orders

All orders placed by you are subject to acceptance by Need That Idea. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in your order.

Order Confirmation

Once we receive your order, we will send you an order confirmation email detailing the products you have ordered, the price, and any applicable shipping costs. This email does not signify our acceptance of your order; it is simply a confirmation that we have received your order.

Order Changes and Cancellations

If you need to change or cancel your order, please contact our customer service team at customerservice@needthatidea.co.uk as soon as possible. We will do our best to accommodate your request, but we cannot guarantee that changes or cancellations can be made once the order has been processed.

5. Warranties and Liability

Product Warranty

We warrant that the products purchased from Need That Idea will be free from defects in material and workmanship under normal use for a period of 12 months from the date of delivery. This warranty does not cover damage caused by misuse, abuse, or unauthorised modifications.

Warranty Claims

To make a warranty claim, please contact our customer service team at customerservice@needthatidea.co.uk. We may require proof of purchase and a detailed description of the defect.

Limitation of Liability

To the fullest extent permitted by applicable law, Need That Idea shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the products; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our website; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

6. Governing Law

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

7. Dispute Resolution

Informal Resolution

We aim to resolve any concerns or disputes you may have quickly and to your satisfaction. If you have any issues, please contact our customer service team at customerservice@needthatidea.co.uk. We will work with you to resolve the issue informally.

Binding Arbitration

If a dispute cannot be resolved informally, you and Need That Idea agree to resolve any claims, disputes, or controversies (excluding claims for injunctive or other equitable relief) arising out of or relating to these Terms through binding arbitration. This agreement to arbitrate is intended to be broadly interpreted.

  • Arbitration Rules: The arbitration will be conducted by the London Court of International Arbitration (LCIA) under its rules and procedures, as amended by these Terms.
  • Arbitration Location: Unless you and Need That Idea agree otherwise, the arbitration will be conducted in London, United Kingdom.
  • Arbitration Fees: Each party will be responsible for paying any LCIA filing, administrative, and arbitrator fees in accordance with LCIA rules.
  • Arbitrator’s Authority: The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this agreement to arbitrate, including any claim that all or any part of this agreement to arbitrate is void or voidable.
  • Decision: The arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction.
  • Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this specific provision is found to be unenforceable, then the entirety of this arbitration clause shall be null and void.

Exceptions to Arbitration

Despite the above, either party may bring an individual action in small claims court if the claim is within the jurisdiction of that court. Additionally, we both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

8. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of our products after any changes constitutes your acceptance of the new Terms.
